General terms and conditions of sale
Article 1 – Purpose and Scope
The purpose of these Terms and Conditions is to define the rights and obligations of MAISON BLANC on the one hand, and consumers and non-professional buyers (hereinafter referred to as the “Customer”) on the other hand, as part of the ordering process, payment, delivery and return of products offered for sale by MAISON BLANC on its website www.maison-blanc-parfum.com (hereinafter referred to as the “Website”).
They are the basis of the business relationship between MAISON BLANC, represented by the sole proprietorship ROMAIN BLANC, domiciled at 22T boulevard du Valclaret, 06600 ANTIBES, France, registered under number SIREN 952 822 690 at the Trade and Companies Register of Antibes, identified for VAT under number FR 11952822690 (hereinafter referred to as “MAISON BLANC”), and the Customer (jointly referred to as “the Parties”) enter into relationship.
The MAISON BLANC website offers the Customer the possibility to place online orders for MAISON BLANC branded products (hereinafter referred to as “the Product(s)”) in accordance with these Terms and Conditions of Use and Sale, abbreviated as “T&Cs”.
The TOS are available at all times on the MAISON BLANC website.
The GTC are subject to change at any time without notice by MAISON BLANC.
The version of the Terms and Conditions applicable to the Customer’s purchase is the one in force on the website of MAISON BLANC at the date of placing the order by the Customer.Before confirming his order online, the Customer declares to have read the General Terms and Conditions of Sale (GTCS) and to have accepted them by checking the box “I accept the General Terms and Conditions of Sale” on the summary page of the order.The Customer acknowledges that he/she has the legal capacity to enter into a contract and purchase the Products offered on the Site.
Article 2 – Product characteristics and Product orders.
2.1 General
Any order placed on the MAISON BLANC website leads to the conclusion of a distance contract between the Customer and the MAISON BLANC online shop. This order implies the full acceptance, without reservation or restriction, of these General Terms and Conditions of Sale (GTCS) by the Customer.
The MAISON BLANC website exposes the characteristics of the Products offered for sale, including specifications, illustrations, as well as indications of dimensions or capacity of the Products.
The Products available for sale are specialty perfumes, such as eaux de parfum offered in 50 ml, 100 ml or sample boxes.
Due to chromatic variations caused by the screen used and the Internet browser, the Customer is informed that colour differences may exist between the photos displayed on the MAISON BLANC website and the products delivered to the Customer.
MAISON BLANC is not responsible for these differences, which do not affect the essential characteristics of the Products.
The Customer is solely responsible for the choice and purchase of a Product. It is therefore recommended that the Customer carefully consult the description of each Product before placing an order, in order to familiarise himself/herself with its properties and particularities, especially with regard to the desired characteristics and size.
The Customer is liable for any consequences resulting from the transmission of false, inaccurate or illicit information.Product offers are valid as long as they are visible on the MAISON BLANC website and within the limits of available stocks.MAISON BLANC reserves the right to cancel or refuse an order in case of suspected fraud or dispute with the Customer regarding the payment of a previous order.
2.2 Ordering
The order is made in several steps that the Customer is invited to follow as follows:
– Select the desired format on the fragrance page, then click on “add to basket”.
– Adjust the product quantities (with a limit of a maximum of 6 units per reference).
– Once you have made your selection and adjusted the quantity, click on the “Shopping basket” icon at the top right of the screen, then on “Confirm order”.
– On the summary page of your selection, you can enter any gift or promotional code, then click on “Checkout”.
– Log in to your account if you have one, or enter the required information.
– Choose a payment method.
– Confirm your order. Throughout the ordering process
Customers can check the details of their order, its total price and correct any errors before confirming their order.
Information concerning the availability of Products is communicated when the order is confirmed.
The order will only be processed once full payment has been received from the Customer.
The sale will only be considered final after the Website has sent the Customer a confirmation of the acceptance of the order by email and after MAISON BLANC has received the full price. The Customer will receive an email confirming the validation of his order, with a detailed summary of the items ordered.
They may follow the progress of their order on the Site and contact Customer Services via our contact form or on 07 75 73 95 95. The Products offered for sale on the MAISON BLANC Website comply with the standards in force in France.
2.3 Access to the user account
It is necessary to create a user account on the Website in order to take advantage of all MAISON BLANC’s offers, including private sales and other commercial operations reserved for the Website’s customers. By creating an account, the Customer certifies that all the information provided is true and accurate, and accepts our data protection policy as detailed in article 4 of the legal notice.

2.3.4 Changing your password and user details

The Customer is hereby informed that he/she may modify the information relating to his/her account, login and password at any time from his/her user account. Customers are reminded that this information is personal and confidential, and they undertake to keep their password secure, refraining from divulging it to third parties for any reason whatsoever.
Article 3. Availability of Products and Disclaimer
Despite the efforts of MAISON BLANC to ensure the accuracy of texts, images and prices displayed on the website and the online shop, errors may occur. In case of stock error or unavailability affecting an order, MAISON BLANC will inform the Customer by e-mail as soon as possible. The Customer’s order will then be cancelled. MAISON BLANC cannot guarantee the absence of inaccuracies or typographical errors in the content of the MAISON BLANC website at any time. In addition, we cannot ensure that all information is constantly updated. MAISON BLANC reserves the right to modify at any time the content of the website and the selection of products available.
The Customer will be reimbursed for the amounts already paid within thirty (30) working days from the date he was informed of the cancellation of his order by MAISON BLANC, by the same means of payment used for the order.
MAISON BLANC does not offer the sale of Products on the website www.maison-blanc-parfum.com to professionals, but only to consumers or non-professionals for personal use. Therefore, MAISON BLANC reserves the right to refuse orders of the same Product in large quantities, including more than 5 pieces of identical items.
Article 4 – Prices and terms of payment
4.1 Prices
The Products sold are invoiced according to the current prices displayed on the Site at the time of payment of the order, as well as the applicable VAT rate, which is that in force on the day of the order.
The prices of the Products displayed on the Site are in Euros and include all taxes (V.A.T.).The prices of the Products do not include shipping, customs, transport or delivery costs or any applicable discounts.
Offers are valid as long as they are visible on the site. Customers are invited to check that the price of the products to which they are referring corresponds to the price displayed on the current page of the www.maison-blanc-parfum.com website and not to an out-of-date page.
The Customer is informed of the amount of the delivery charges before the final confirmation and payment of his/her order.
Before final confirmation of their order, Customers will be informed of the amount of the delivery charges.
The price displayed when the order is paid for is the final price including delivery costs.
These delivery costs, expressed inclusive of all taxes, are invoiced in addition to the sale price of the Products and are payable by the Customer.
Customs duties, local taxes, import duties or other similar levies may be required. They will be the sole responsibility of the Customer.
MAISON BLANC reserves the right to modify the prices of the Products at any time, without this modification having any impact on an order already validated.
4.2 Payment
The payment requested from the Customer corresponds to the total amount of the order, including shipping, transportation and delivery costs. The total amount of the order must be paid in full on the day the order is placed by the Customer. The amounts paid by the Customer do not constitute a deposit. The price of the Products purchased must be paid in full at the time of the order by the Customer MAISON BLANC will not be required to deliver the Products ordered by the Customer if the full price has not been paid beforehand.
No COD shipment will be allowed for any reason whatsoever.
After the validation of the order by the Customer, MAISON BLANC will send a confirmation email to inform the Customer that his order has been registered.
The information provided by the Customer and recorded on the Website www.maison-blanc-parfum.com during the order constitutes proof of the transactions between MAISON BLANC and the Customer.
4.3 Transfer of ownership.
The ownership of the Products is transferred to the Customer only after full payment of the price. The transfer of risk of loss and deterioration of the Products takes place upon delivery and receipt by the Customer.The Customer may pay for his/her order using various secure online payment methods, such as:- bank card (Visa, Eurocard/Mastercard, other credit cards).
Transactions carried out on the Site are managed by our online payment service provider. The Customer’s bank card payment details are secured and encrypted by this service provider.
By clicking on “Pay”, the Customer confirms that he/she is the owner of the bank card.
Article 5 – Deliveries and returns
5.1 Delivery policy
We take great care to ensure that your orders are delivered correctly.All our parcels are delivered to you against signature.Orders are processed in the order in which they are confirmed.
After confirmation, your order is ready to be dispatched as soon as possible. Products purchased by the Customer will be delivered within a maximum of thirty days from the date of the order, to the address indicated by the Customer on the MAISON BLANC website.
If this period is exceeded, except in cases of force majeure justified, the Customer may request the cancellation of the sale in accordance with Article L.114-1 of the Consumer Code and obtain a refund of sums paid at the time of purchase.
The MAISON BLANC website declines all responsibility and will not refund in case of incorrect or incomplete address provided by the Customer. Except in exceptional circumstances or unavailability of one or more Products, the delivery of Products ordered will be made at once. The Products are sent, together with the delivery note, to the delivery address indicated by the Customer when placing the order.
Delivery may not be made to hotels, post office boxes or lock-ups.
The delivery times mentioned on the Website are given as an indication.
MAISON BLANC will do its best to deliver the products ordered by the Customer within the time specified, after validation of the order and subject to payment.
MAISON BLANC will keep the Customer informed of the progress of his order by e-mail.
It is the Customer’s responsibility to check the conformity of the delivery with the order and to report any error without delay.The Customer is also responsible for checking the condition of the Products delivered.
Depending on the delivery destination and the shipping method chosen, the shipping costs are automatically calculated.Unfortunately, we are unable to deliver our products to all countries.
Once your order has been processed, deliveries are made by independent carriers.

Zone 1: Germany, Belgium, Luxembourg, Netherlands.
Zone 2: Austria, Spain (excluding islands), Guernsey, Italy (San Marino, Vatican, Livigno, Campione d’Italia, San Marino), Jersey, Portugal (excluding islands), United Kingdom.
Zone 3: Denmark, Estonia, Greenland, Hungary, Faroe Islands, Latvia, Liechtenstein, Lithuania, Poland, Czech Republic, Slovakia, Slovenia, Sweden, Switzerland.
Due to the nature of the products offered by MAISON BLANC, and customs restrictions, it is currently impossible to place an order for any delivery address outside these territories.
We are currently working to satisfy your orders to be shipped to more and more destinations.
Notes on the transport of flammable products:
All shipments of flammable products must be declared and shipped in accordance with customs regulations for dangerous goods.
The transport of perfume is no exception to the rule.
The transport of perfume is subject to these customs obligations for flammable products and gives rise to additional duties and taxes depending on the country of destination, which are payable in full by the Customer.

Free delivery:
Free delivery is offered by la MAISON BLANC in certain countries and according to the value of a single purchase.
After having selected the destination and the shipping conditions of your order, the shipping discounts will be applied before finalizing the order, on the final payment page.
5.1.1 Delivery FRANCE – CONTINENT only

Home delivery within an average of 48 hours, between 8 a.m. and 6 p.m. (two working days – indicative delivery time).
Delivery against signature.
If the recipient of the parcel is absent, a delivery notice will be left at the address. The recipient may then request a second delivery or collect the parcel from the post office indicated on the delivery notice. The parcel must be collected within 15 days, after which it will be returned to the sender. Any costs associated with a second delivery will be borne by the purchaser. Delivery times are purely indicative and any delays in delivery will not give rise to any damages or compensation. 5.2. Receipt of the order
We remind you that it is the Customer’s responsibility to check the condition of their order and its contents on arrival.
The Customer undertakes to indicate on the delivery note any concerns or problems encountered, particularly if the parcel appears to have been opened, damaged or handled inappropriately.
In the event of damage to the items ordered, it is recommended that you refuse the parcel, clearly explaining the reasons.
We encourage you to contact our customer service department via our contact form on the day of delivery of the parcel, providing details of your complaint and the corresponding supporting documents.

Signing without reservations upon receipt of the package is equivalent to acceptance of the package as is, and MAISON BLANC cannot be held responsible for any accidental damage resulting from shipping and transport.
Article 6 Returns Policy
6.1 Return, exchange and refund procedure
You may request an exchange or refund of items within 14 days of delivery of your order. To do this, please contact us via our contact form, stating your order number and your decision to return the products. Clearly specify the items you wish to return and the action you wish to take (exchange or refund).
Be sure to pack the products carefully and include the delivery note supplied with the delivery before closing the parcel.
6.2 Return, exchange and refund conditions
All items for which an exchange or refund is requested must be returned in unused condition, accompanied by the original invoice.
The Customer must return the Product in the same condition in which it was received.
Products must be returned in their original, unopened packaging with the protective film. Products may not be tried on, and must be in new condition, unopened, unused, undamaged, undirty and untested.
All items submitted for exchange or refund must be returned in unused condition, accompanied by the original invoice.

To ensure maximum protection of the items, the Products must be repositioned in the original package, resistant to the various transport tests.
MAISON BLANC reserves the right to refuse the return if the returned Product is unfit to be put back on the market as new (Product returned incomplete, damaged, for example).
The original labels and packaging must be completely intact.
Items whose labels have been removed will not be accepted.
To ensure maximum protection of the items, it is necessary to put the Products back in the original packaging, designed to withstand the various transport tests. MAISON BLANC reserves the right to refuse the return if the returned Product is not in new condition and ready to be put back on the market (for example, if the Product is incomplete, damaged or spoiled).The original labels and packaging must be completely intact.
Items with labels removed cannot be accepted for return or refund.
Returns will only be accepted under these conditions.
It is your responsibility to send the returned items to MAISON BLANC. We recommend our customers to choose a tracking option for their parcel in order to avoid any problem, especially in case of loss or theft of the Products during the return, and to be able to justify their sending.
Shipping costs for returned items are the responsibility of the Customer. Please note that items lost during transport will not be refunded.
La MAISON BLANC does not apply any additional shipping costs for exchanges.
Refunds for returned items will be made within two weeks of receipt of the product, using the same payment method used for the original transaction. Please note that additional duties and/or taxes will not be refunded, nor will shipping costs.
VAT is included in the refund for orders to the European Union.
All exchanges are subject to availability.
Defective items will be exchanged for the same type of product, subject to availability.
For the same defective items, refunds may be made within 14 days of delivery.Exchanges and returns can only be made according to the terms and conditions described on the MAISON BLANC website following the General Terms and Conditions of Sale. 6.3 Non-conformity
The Customer has a period of 14 days from the date of delivery to express by registered mail to MAISON BLANC – Service des retours, 22T bd du Valclaret, 06600 ANTIBES, or by email via our contact form, any reservations or claims regarding non-conformity or apparent defects of the Products delivered, providing all necessary evidence.
If these formalities are not respected within the deadline, the Products will be considered compliant and free of any apparent defect and no claim will be accepted by MAISON BLANC.
In case of apparent defects or lack of conformity of the delivered Products are duly proven by the Customer, MAISON BLANC commits to replace quickly and at its own expense the Products concerned.
In case of return due to a delivery error, any Product that does not correspond to the order must be returned with the Delivery Note to the following address: MAISON BLANC, Service des Retours, 22T bd du Valclaret, 06600 ANTIBES. The non-conforming product will be reimbursed within 7 days from the reception of the returned item.
The shipping and return costs for the non-conforming Product will be paid by MAISON BLANC.
Article 7 – Right of withdrawal
In accordance with the provisions of articles L. 221-18 and following of the Consumer Code, the Customer has a withdrawal period of 14 days from the delivery of the Products to return them to MAISON BLANC for a refund.
The Customer can return the purchased Product at the latest within fourteen (14) days after having informed his decision to withdraw. It is essential that the Customer respects the conditions and procedure for returning Products.
The date shown on the delivery note will be taken as proof, subject to compliance with the GCS.
The Products must be returned in their original and complete condition, allowing them to be sold as new, accompanied by the original invoice.
To exercise his right of withdrawal, the Customer does not need to provide any justification and must inform MAISON BLANC of his decision to withdraw using the model withdrawal form available in the appendix of these Terms and Conditions, by e-mail via our contact form.
The Customer will receive an e-mail acknowledging his decision to withdraw as soon as possible.

7.1 Refunds
In accordance with article L. 221-24 of the French Consumer Code, MAISON BLANC commits to reimburse the Customer within fourteen (14) days from the date it was informed of the Customer’s decision to withdraw. However, if the returned Products are not received or if no proof of shipment is provided within this period, MAISON BLANC reserves the right to defer the reimbursement until receipt of the Products concerned or until the Customer provides proof of shipment, and this within a maximum period of 30 days from the exercise of the right of withdrawal.
The sums paid by the Customer, including delivery costs, will be refunded in full by the same means of payment used for the initial transaction. The cost of returning the goods shall be borne exclusively by the Customer.
If the Customer has paid for his/her order using two methods of payment, including a purchase voucher, the refund will be made in proportion to each method of payment, meaning that the Customer will receive part of the refund in the form of a purchase voucher. In case of partial return of Products, the shipping costs will not be reimbursed by MAISON BLANC, as the Customer has benefited from the delivery service for the retained items, the shipping rates remaining unchanged regardless of the volume of the order. If Products are returned outside the mentioned period, the Customer will not be reimbursed and will be informed that the Products remain available at the warehouse for a period of 1 month. At the Customer’s request, the Products may also be returned at the Customer’s expense.
Article 8 – Data protection
The Customer is informed that information relating to his/her order is subject to automated data processing.
In accordance with Law 78-17 of 6 January 1978, it is specified that the personal data requested by the Customer are essential for the processing of his order and are intended for internal use by MAISON BLANC. However, these personal data may be communicated to third parties, partners of MAISON BLANC. Regarding the information concerning him, in accordance with current legislation, the Customer has a right of access, modification, rectification in his “my account” and opposition by contacting customer service by email via our contact form.
This automated data processing aims to establish a level of analysis of transactions and to prevent credit card fraud. La Boutique online MAISON BLANC may request supporting documents from the customer (ID in the name of the cardholder, proof of address, etc.). If the customer refuses to provide these documents or information, MAISON BLANC will cancel the order and refund the Product. In case of non-payment due to fraudulent authorization of a credit card or inaccurate or misleading statements by the customer, the details related to the order associated with this non-payment will be recorded in a payment incident file managed by the Website.
Article 9 – Intellectual property
All elements of the website www.maison-blanc-parfum.com are and remain the exclusive intellectual property of MAISON BLANC or its supplier. It is strictly forbidden for the customer or any other person to reproduce, exploit, distribute or use, even partially, elements of the website mentioned. The company names, brands and distinctive signs of the Products on the website www.maison-blanc-parfum.com are protected by trademark law;
The reproduction or representation of all or part of these elements is strictly prohibited.
Article 10 – Disputes and applicable law
Any dispute must be the subject of a prior attempt at amicable settlement.
To this end, a request for amicable settlement must be sent by e-mail via our contact form. The Customer is informed of the possibility of having recourse to consumer mediation in the event of a dispute, in accordance with the provisions of Book VI of the Consumer Code, in particular by contacting MÉDIATION DE LA CONSOMMATION & PATRIMOINE – 12 Square Desnouettes – 75015 PARIS.
In accordance with the provisions of articles L 611-1 and R 612-1 et seq. of the French Consumer Code concerning the amicable settlement of disputes: When the consumer has sent a written complaint to the professional and has not received satisfaction or a response within two months, he may submit his complaint free of charge to the Consumer Ombudsman. The complaint must be referred to the mediator within one year of the initial complaint.

In accordance with Article 14 of Regulation (EU) No. 524/2013, the Customer is hereby informed that the European Commission has set up an Online Dispute Resolution platform for the independent, out-of-court settlement of online disputes between consumers and professionals in the European Union: https://webgate.ec.europa.eu/odr/.Disputes that cannot be resolved amicably will be submitted to the competent French courts.
MAISON BLANC reserves the right to use all legal and equitable means in the event of non-compliance with these terms and conditions, including the possibility of blocking access to the site. Individuals found to be in breach of access restrictions to password-protected areas may be subject to prosecution. All disputes arising from this agreement, whether relating to its validity, interpretation, performance, termination, consequences or consequences thereof, shall be submitted to the competent courts in accordance with the rules of common law.
By accepting this agreement, you acknowledge the exclusive jurisdiction of the French courts for any dispute relating thereto. As the laws of your country may differ from French law, there may be additional legal requirements to use this website. You are required to comply with all applicable local and international laws and regulations relating to your use of the website.
Article 11 Force Majeure
In case of Force Majeure as defined in Article 1218 of the Civil Code, the Parties shall not be liable. The obligations of MAISON BLANC will be suspended. In this situation, the contract between you and MAISON BLANC may be partially or totally terminated by either party. The party establishing the case of force majeure must immediately inform the other party in writing of its inability to perform its obligations and justify it. A case of Force Majeure is an event such as war, civil war, revolution, riots, government measures, strike, lock-out, blockage, electricity, telephone or internet failure, natural disasters or similar events.
The suspension of obligations in the event of Force Majeure shall under no circumstances give rise to liability or to the payment of damages or late penalties. The execution of these Terms and Conditions will be suspended for the duration of the case of force majeure. In such circumstances, MAISON BLANC will do its utmost to solve the problem for its customers as soon as possible and in a comprehensive manner.
If the case of force majeure or fortuitous event persists permanently or exceeds a period of sixty (60) days, these Terms and Conditions of Sale will be terminated automatically and without formality. In this case, the sums paid by the Customer for his/her order will be returned.
11.1 Autonomy of provisions
If any of the clauses of these General Terms and Conditions of Sale were to be declared null and void or unenforceable by a competent court, this clause would then be deemed unwritten, without this leading to the nullity of the other clauses. The General Terms and Conditions of Sale will nevertheless remain in force to govern the commercial relationship.
