Legal guarantee of conformity

Article L 217-4 of the French Consumer Code: 

The seller is obliged to supply goods that conform to the contract and is liable for any lack of conformity at the time of delivery. He is also responsible for any lack of conformity relating to the packaging, assembly instructions or installation, if this was his contractual responsibility or carried out under his supervision.

Article L 217-5 of the French Consumer Code

The goods conform to the contract:


1° If it conforms to the use normally expected of similar goods and, where applicable : – if it corresponds to the description given by the seller and has the characteristics presented to the buyer in the form of a sample or model; – if it has the characteristics that a buyer may legitimately expect on the basis of public statements by the seller, the manufacturer or its representative, particularly in advertising or labelling;

2° Or if it has the characteristics agreed by the parties or if it is adapted to a specific use sought by the buyer, brought to the attention of the seller and accepted by the latter.

Any action for lack of conformity must be brought within two years of delivery of the goods. Warranty against hidden defects

Article 1641 of the French Civil Code

The seller is liable for any hidden defects in the item sold which render it unfit for the purpose for which it was intended, or which reduce its usefulness to such an extent that the buyer would not have purchased it or would have demanded a lower price had he been aware of them.

The buyer must bring an action for latent defects within two years of the discovery of the defect.
